Cybersecurity, data protection and transfer are critical issues for businesses when trading across international borders. Many businesses now operate business models that rely on the ability to process, store and transfer customer data. European SMEs have largely adapted to GDPR and other national data privacy laws, while an increased awareness of cybersecurity threats have also encouraged business to take stronger measures to improve cybersecurity and protect customer data. The basic legal framework for cybersecurity and data protection in China was completed in 2021, with the issuance of the Personal Information Protection Law (PIPL) and the Data Security Law (DSL) – in addition to the previous Cybersecurity Law enacted in 2017. Other department rules and standards are also being drafted, outlining different levels of risk for data, stipulating provisions for data collection and storage, and indicating the conditions and criteria for the transfer of data across borders. These pose significant technical challenges to European SMEs in terms of adjusting their cloud infrastructure and ensuring the continuity of their cross-border operations. Join the webinar "Cybersecurity and Data Protection in China: Compliance: Challenges and Tips", organized by the China-Italy Chamber of Commerce (CICC) together with the EU SME Centre on May 24th, 2022 from 4:00 to 5:30 pm, to get an update on the most recent regulatory developments in the field of cybersecurity and data protection. He is experienced in cyber-security, TMT, technology transfer, AI, IoT, cross-boarder M&A projects, and foreign investment cases including setting up legal entities in China, Italy, and Spain, and preparing cross-border contracts and transactions. In 2021, Mr. Lucini was appointed Arbitrator before the Hainan Arbitration Court. Mr. Lucini is also Vice-Chair of the Next Generation Committee of the Inter-Pacific Bar Association in which he participated as a panelist in important lectures and seminars regarding innovation and the legal profession including the application of innovative methodology as Design Thinking to the law. The China-Italy Chamber of Commerce (CICC) together with the EU SME Centre and the European Union Chamber of Commerce in China invite you to attend the seminar "New Regulations and Animal Testing Exemption for Cosmetics", to be held next April 12, 2022 ONLINE and OFFLINE (CICC Beijing Office and CICC Guangzhou Office, see address below). The Cosmetic Supervision and Administration Regulation (CSAR) came into effect on 1 January 2021, representing the new, overarching cosmetic regulatory framework in China. CSAR has detailed provisions for cosmetic classification, product notification and registration, new ingredient management, efficacy evaluation, safety assessment, online cosmetic supervision, accountability systems, punitive measures, etc.  Simultaneously, in May 2021 a new, long-awaited milestone came into force: the possibility for imported general cosmetics to be exempted from mandatory animal testing in China, and thus opening up the Chinese market to several European cruelty-free brands which previously could only export limited quantities through cross-border e-commerce, or were not exporting at all. Yet, to animal testing exemption a certain documentation must be provided from the manufacturer’s home country, which is a challenging process. In February 2022, the EU SME Centre updated its flagship report How to Export Cosmetics to China (2022 Regulations Update) to help EU companies in the process. This workshop reviews the impact of CSAR and other relevant cosmetics regulations after more than 1 year of implementation.
