Event Recap | Comments on Draft Amendments to Chinese Trademark Law

27 April 2023

On Thursday, April 27th, the China-Italy Chamber of Commerce (CICC) and its Intellectual Property Working Group (IPWG) held the online seminar: "Interview with IP Experts: Draft Amendments to Chinese Trademark Law. "

The webinar was moderated by Carlo Geremia, IPWG Coordinator and Senior Counsel at ADVANT Nctm Shanghai, China.

For this new episode of an interview with IP Expert, we welcomed Charles (Chao) Feng, Senior Partner and Director of the International Business Department at Tahota, who analyzed the new draft amendments to the Chinese Trademark Law and their implications, focusing in particular on bad faith applications and the prohibition of repeating applications.

During the event, it was underlined how the new changes, if implemented, could help the Italian Companies to protect their trademark and reduce the risk of trademark infringements and squatting.

However, it is still necessary to watch the process of legislation. The current version of the law still has unsettled matters.

"Keep monitoring trademark application and registration status in China… Earlier filing remains the most cost-effective approach under the current law unless the new provisions are officially implemented as expected." — Charles Chao Feng, Senior Partner and Director of the International Business Department at Tahota
