Learn How to Protect Your Design with our IP Experts

The China-Italy Chamber of Commerce (CICC), its Intellectual Property Working Group (IPWG), and the China IP SME Helpdesk organized the first session of the workshop “Design Protection in China” on June 29th. The workshop in two sessions is organized with the support of CAASA and aimed at training companies and individuals on how to protect design in China through design patent and copyright.

The second session of the workshop will be held on July 6th. For those interested to attend we invite you to register following the instructions at the end of this post.

During the first session, our IP experts provided an overview of how to register design patents in China and practical examples of enforcement.

The workshop was opened by Raffaello Girotto, Legal Attaché at the Italian Embassy in Beijing, who highlighted that Italian enterprises should be aware of the differences between the regulatory environments on design patents existing in Italy and China, and make the most of the IP protection instruments offered by local law. He also reminded the audience of the several assistance channels made available by the Italian Government to companies needing to protect their IP in China.

Our first expert Ms. Lisa Lu, IP Business Advisor at China IP SME Helpdesk, gave an overview of design patent protection in China, underlining the difference between a national design patent and an international design. She then discussed in detail the registration procedures, including the documents needed and costs for both methods. She also analyzed the difference between the EU’s and China’s design protection systems regarding rights, protection terms, and grace periods.

“We give the same quiz before and after the training. From the quiz results, we can see that after the training, the participants have already learned some very important knowledge about design protection in China: The design patent in China protects the aesthetic features of the products, not the function; register the design patent in China before it is known to public; if the companies have applied for design in EU, they can still file design patent in China within 6 months; please have the Chinese design patent registration certificates ready for enforcement.” Lisa Lu

Our second expert, Ms. Wang Di, Patent Attorney & Attorney-at-Law at Shanghai Patent & Trademark Law Office, LLC, focused on design patent enforcement in China, particularly how to enforce design patent rights in case of copycats or infringement. She trained companies to collect evidence and apply for a Patent Evaluation Report (PER). In recent years, new tools that are more convenient and accessible have been developed to facilitate the collection of electronic evidence.
