Post-event - SAIC New Internet Advertising Law Seminar

Dear Members and Friends of CICC,

Wednesday, 12th October 2016, SAIC New Internet Advertising Law Seminar, was held at Fesco-Adecco Shanghai, China.

Seminar Content:

- Introduction of the Interim Measures for the Administration of Internet Advertising 2016;

- Overview of the main principles and restrictions applicable to advertising since the 2015 Advertising Law;

- New regulation of online advertising 

The seminar started with the presentation by the Head of Division Advertising Supervision and Management Shanghai Administration for Industry and Commerce (SAIC), Mr. YIN Jun. He did a brief introduction of the Interim Measures, explaining the legal liability issues about the webpages’ content after opening network links and the situation of the Internet advertising regulatory enforcement in Shanghai.

          

The seminar continued with the presentation by the Head of corporate & food/drug regulatory at HFGIP, Mr. Nicola Aporti, who focused on food products advertising in China. He highlighted the importance of advertising campaigns which became more and more tailored on Chinese consumers and aggressive, and also about food companies which should be very careful not to trespass the limits imposed on advertising by Chinese regulation. He illustrated the general principles, the superlative expressions, the specific regulation, the health food for special dietary use, the mislabeling and sanctions.

           

The meeting ended with Paola Perinu, BLB Studio Legale in alliance with Huashang Law Firm. She focused on the following topics:

1. Scope of the new Chinese regulation on Internet Advertising

2. Legal issues deserving to be considered in online advertising

3. Compliance with the new Chinese regulation on Internet Advertising

4. Challenges for foreign companies operating in China

5. Legal consequences       

6. What being unaware of Internet advertisement can lead to: Wei Zex
